Terms & Conditions

The rules that govern your use of this website and my freelance web development services.

Section 01

Acceptance of these terms

These Terms and Conditions govern your use of this website and any web development services provided by Saikat Roy ("Saikat's World"). By using the website, requesting a quote, or engaging me for a project, you agree to these terms.

Section 02

Description of services

I provide freelance web design and development services — custom websites, web applications, WordPress and WooCommerce builds, Laravel and PHP systems, REST APIs, eCommerce stores, dashboards, deployment and ongoing support.

  • The exact scope, features and deliverables for your project are described in the written proposal or statement of work we agree on.
  • Anything outside that agreed scope is quoted separately before work begins.
  • I may improve or adjust how I deliver services over time; material changes to an active project are always discussed first.

Section 03

Quotes, payment and timeline

  • Quotes are fixed for the agreed scope and valid for 30 days unless stated otherwise.
  • Payments follow the schedule in your proposal — typically an advance and milestone payments — invoiced per agreed checkpoints.
  • Invoices are payable within 7 days unless agreed differently in writing. Continued delay may pause work until accounts are settled.
  • Timelines assume timely content, feedback and approvals from your side; delays on those shift the schedule fairly.
  • Advance payments cover work already scheduled and are non-refundable once that work is done, except where required by law.

Section 04

Your responsibilities

  • Provide accurate, current information and the content, credentials and access your project needs.
  • Confirm that you own or have the right to use any text, images, logos and data you supply.
  • Review deliverables and share consolidated feedback within the timeframes we agree on.

Section 05

Revisions and scope changes

  • Each project includes the revision rounds stated in your proposal.
  • New pages, features or integrations requested mid-project are quoted as additions before they are built.
  • I will always flag it clearly when a request changes the scope or the price.

Section 06

Acceptable use

When working with me or using anything I build for you, you agree not to:

  • Use the deliverables or this website for any unlawful purpose.
  • Supply content or data you do not have the right to use or process.
  • Attempt to probe, breach or disrupt the security of this website or other clients' systems.
  • Misrepresent your identity or use my services to send spam or harass any person.

I may pause an engagement that violates these rules, with notice where practicable, while we resolve it.

Section 07

Warranty and support

  • Every build ships working as described in the proposal, and I fix bugs in my own code reported during the support window we agree on, at no extra cost.
  • Support beyond that window — updates, new features, maintenance — is available as a separate agreement.
  • Support covers my code and configurations; issues from third-party services or client-side edits are quoted separately.

Section 08

Intellectual property

On full payment, you own the final delivered website, code and design produced specifically for your project.

I retain the rights to my reusable internal components, tools and know-how, and — unless we agree otherwise in writing — the right to feature the completed work in my portfolio.

Third-party assets used in a project (fonts, plugins, libraries, images) remain governed by their own licences.

Section 09

Confidentiality

Each of us will protect the other's confidential information with at least the same care we use for our own, and use it only for the purposes of the project. Handling of personal data is described in the Privacy Policy, which forms part of these terms.

Section 10

Third-party services

Projects may rely on third-party services such as hosting, payment gateways, SMS and email providers or cloud infrastructure. Your use of those services is also governed by the third party's own terms, and I am not responsible for their acts or omissions beyond what your proposal states.

Section 11

Disclaimers and limitation of liability

Services are provided with reasonable skill and care. To the extent permitted by law, other implied warranties are excluded.

  • Neither of us is liable for indirect, incidental, special or consequential damages, or for lost profits or lost data, however caused.
  • My total liability for any claim is limited to the fees you paid for the project in the 12 months before the claim arose.
  • Nothing in these terms limits liability that cannot be limited by law, including for fraud or gross negligence.

Section 12

Pausing or ending a project

  • Either of us may end an engagement with written notice.
  • Work completed up to the notice date is invoiced and payable; completed work is handed over.
  • If I ever need to step back mid-project, I will hand over everything completed, along with documentation, so you are never stuck.
  • Sections that by their nature should survive — confidentiality, liability and governing law — survive the end of an engagement.

Section 13

Governing law and disputes

These terms are governed by the laws of India, and the courts of West Bengal have exclusive jurisdiction.

Before anything formal, please raise the issue with me directly — I commit to a good-faith resolution attempt within 30 days.

Section 14

Changes to these terms

I may update these terms from time to time. The current version is always on this page with the last-updated date at the top. Active projects continue under the terms agreed in their proposals.
